Acceptable Use Policy

1.

Purpose

This Acceptable Use Policy ("AUP") governs the use of the SHAKE International marketplace platform operated by LEVIER (Pty) Ltd ("SHAKE"). All registered users — buyers and sellers — must comply with this AUP. Use of the platform constitutes acceptance of these rules.

What May Be Listed

SHAKE is a marketplace for industrial equipment only. Permitted listings include:

  • Tractors, harvesters, planters, sprayers, and other self-propelled farm machines
  • Implements, attachments, and tillage equipment
  • Irrigation systems and related infrastructure
  • Post-harvest, storage, and grain-handling equipment
  • Construction plant, earthmoving machinery, and material-handling equipment
  • Genuine spare parts and components for the above categories

Listings must accurately represent the item, its condition, year of manufacture, asking price, and location. Misrepresentation — including altered photographs, incorrect specifications, or fictitious pricing — is prohibited.

Prohibited Listings

The following are strictly prohibited on SHAKE:

  • Consumer goods, household items, or non-agricultural/non-construction equipment
  • Stolen equipment or equipment obtained by fraudulent means
  • Equipment with tampered, removed, or falsified serial numbers
  • Equipment subject to a finance agreement where the financier has not consented to the sale
  • Equipment under active legal dispute, seizure, or attachment order
  • Counterfeit or non-genuine spare parts
  • Duplicate listings of the same item by the same seller
  • Placeholder or "coming soon" listings without real inventory
  • Any item whose sale is prohibited under South African law
4.

Seller Conduct

Sellers are required to:

  • Respond to buyer enquiries promptly and honestly
  • Mark equipment as sold or remove the listing within a reasonable time after a sale is agreed
  • Not list prices that are deliberately misleading or bait-and-switch in nature
  • Disclose all known material defects, damage, or limitations of equipment being sold
  • Hold a valid subscription plan corresponding to the number of active listings maintained
5.

Buyer Conduct

Buyers are required to:

  • Contact sellers only for genuine purchasing enquiries
  • Not harvest seller contact details for unsolicited commercial communications
  • Not impersonate another buyer, company, or industry representative
  • Not use the messaging system to solicit listings off-platform without genuine purchase intent
6.

Platform Integrity

All users must not:

  • Attempt to gain unauthorised access to other accounts, administrative systems, or backend infrastructure
  • Use automated scripts, bots, or scrapers to extract platform data at scale without written permission
  • Introduce malware, viruses, or malicious code into any platform component
  • Interfere with the availability or performance of the platform for other users
  • Post spam, unsolicited advertising, or irrelevant content in messages or listings
  • Use the platform to facilitate money laundering, fraud, or any activity that contravenes the Financial Intelligence Centre Act (FICA) or related South African legislation
7.

Consequences of Violation

SHAKE reserves the right to take the following actions against accounts that violate this AUP, at its sole discretion and without prior notice:

  • Remove or unpublish individual listings
  • Issue a formal warning to the registered account holder
  • Temporarily suspend the account pending investigation
  • Permanently terminate the account without refund of any subscription fees
  • Report the matter to the South African Police Service (SAPS) or other relevant authorities where criminal conduct is suspected

SHAKE is not obligated to retain data for suspended or terminated accounts beyond what is required for legal compliance.

8.

Reporting Violations

If you encounter a listing or user you believe violates this policy, please report it to admin@levier.co.za with the listing URL or account details and a brief description of the concern. We investigate all reports and respond within 5 business days.

9.

Changes to This Policy

We may update this AUP from time to time to reflect platform changes or regulatory requirements. Material changes will be communicated to registered users at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated AUP.
